END USER LICENSE AGREEMENT (Registered and Unregistered Copies of Now You're Cooking!) This License Agreement is a legal agreement between you and Loginetics, Inc. dba Food-for-Thought Software ("DEVELOPER"), developer of the software Now You're Cooking! ("SOFTWARE PRODUCT"). By installing, copying, or otherwise using the SOFTWARE PRODUCT, you agree to be bound by the terms of this agreement. If you do not agree to the terms of this license agreement, the DEVELOPER is unwilling to license the SOFTWARE PRODUCT to you, in which case you may not install, use, copy, or distribute the SOFTWARE PRODUCT. SOFTWARE PRODUCT LICENSE This SOFTWARE PRODUCT is protected by copyright laws and international treaties, as well as other intellectual property laws. This SOFTWARE PRODUCT is licensed, not sold. 1. GRANT OF LICENSE - This license agreement grants you the following rights: UNREGISTERED USER. You have 60 days after your fifth use to evaluate the unregistered version of the SOFTWARE PRODUCT before you are required to register (purchase license to) it. If you elect not to register within the 60 day evaluation period, you must cease using the SOFTWARE PRODUCT. The unregistered version will cease to operate at the end of the evaluation period. You are granted permission to distribute the downloadable unregistered version of the SOFTWARE PRODUCT, provided all the original files are kept together and the archive is not altered in any way. REGISTERED USER. You may install and use one copy of the SOFTWARE PRODUCT on your computer. You may store or install a copy onto a second computer, provided there is no simultaneous use of the two copies. You may use the SOFTWARE PRODUCT on a network, provided that each person accessing it through the network has a copy licensed to that person. A license for the SOFTWARE PRODUCT may not be shared or used concurrently on different computers. BACKUP. You may make a single backup copy of the SOFTWARE PRODUCT, provided you use it solely for archival purposes. REGISTRATION INFORMATION. Distribution of any registration code, registered key, serial number, or any other registration information associated with this SOFTWARE PRODUCT is strictly prohibited. 2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS USE OF SOFTWARE PRODUCT. You may not reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT. You may not alter any of the files in the package for any reason without express written permission from the DEVELOPER. This includes, but is not limited to, modifying any icons, menus, or displays associated with the SOFTWARE PRODUCT. SEPARATION OF COMPONENTS. The SOFTWARE PRODUCT is licensed as a single product. Its component parts may not be separated for use on more than one computer. RENTAL AND RESALE. You may not rent, lease, or sell the SOFTWARE PRODUCT. This restriction does not apply to connect time charges, or flat rate connection/download fees for electronic bulletin board or on-line services. The SOFTWARE PRODUCT cannot be bundled with any other software, books, reports, magazines, or other publications or packages without express written permission from the DEVELOPER. 3. COPYRIGHT All title, copyright, ownership rights, and intellectual property rights in and to the SOFTWARE PRODUCT (including but not limited to any images, photographs, animations, video, audio, music, text, and applets, incorporated into the SOFTWARE PRODUCT and its documentation), shall remain in Loginetics, Inc. d/b/a Food-for-Thought Software. The SOFTWARE PRODUCT is protected by copyright laws and international treaty provisions. You may not copy any printed materials accompanying the SOFTWARE PRODUCT. WARRANTY DISCLAIMER This software and accompanying materials are distributed "AS IS" and without warranty. To the maximum extent permitted by applicable law, the DEVELOPER and its suppliers disclaim any warranty, either express or implied, including but not limited to implied warranties of merchantability and fitness for any particular purpose, with regard to the SOFTWARE PRODUCT, the accompanying written materials, and any accompanying software and hardware. LIMITATION OF LIABILITY To the maximum extent permitted by applicable law, in no event shall the DEVELOPER or anyone involved in the creation, production, or sale of this product be liable for any direct, indirect, consequential, or special damages arising out of any use of the SOFTWARE PRODUCT whatsoever (including without limitation, direct or indirect damages for personal injury, loss of business profits, business interruption, loss of business information, or any other pecuniary loss arising out of the use of or inability to use this SOFTWARE PRODUCT), even if the DEVELOPER has been advised of the possibility of such damages. In any case, the DEVELOPER's and its suppliers' entire liability under any provision of this agreement shall be limited to the price paid by you for the SOFTWARE PRODUCT.
